These Terms of Service ("Terms") constitute a legally binding agreement between you and CalorieAI ("Company," "we," "us," or "our") concerning your access to and use of our Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

CalorieAI is an AI-powered food identification and calorie tracking service that allows users to:

• Upload food photos for AI-powered identification
• Access nutrition information from FatSecret database
• Track daily caloric intake and macronutrients
• Receive AI-generated dietary recommendations (Pro feature)

3.1 Account Creation

• You must provide a valid email address to create an account
• You are responsible for maintaining the confidentiality of your account
• You are responsible for all activities that occur under your account

3.2 Account Restrictions

• Creating multiple accounts to circumvent usage limits is prohibited
• Sharing account credentials with third parties is prohibited
• We reserve the right to suspend or terminate accounts that violate these Terms

4.1 Free Plan

• Limited to 2 food scans per day
• Basic nutrition information only
• No food history retention between sessions

4.2 Pro Subscription

• Unlimited food scans
• Full nutrition data and AI diet coach access
• Permanent food history storage
• Subscriptions auto-renew unless cancelled before renewal date

4.3 Payment Terms

• All payments are processed securely via PayPal
• Prices are displayed in USD and may be subject to taxes
• We reserve the right to change pricing with 30 days notice
• All sales are final - no refunds are provided (see Refund Policy)

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by CalorieAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of content you upload, including food photos. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display such content solely for the purpose of providing the Service.

6.3 DMCA Compliance

We respect intellectual property rights. If you believe any content on our Service infringes your copyright, please submit a DMCA takedown notice to dmca@yangqing.one including:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location
• Your contact information
• A statement of good faith belief
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Important: AI food identification results are for informational purposes only and should not be considered medical advice. Nutrition data is sourced from third-party databases and may not be 100% accurate. Always consult healthcare professionals for dietary decisions.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for any data loss or corruption.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. Pro subscriptions will not be refunded. Provisions of these Terms that should survive termination shall survive.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

Any disputes arising from these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
